The current tax bill for Miami is $4.9M and the Heat will have until the end of the regular season to get under the threshold. Ellington was signed to a one-year contract and can now veto any trade based on the one-year bird restriction. The Heat now have 12 guaranteed contracts and the $5.3M tax midlevel exception remaining.
